1. Introduction

Welcome to ParlaPop! These Terms of Service ("Terms") govern your use of our website, applications, and services (collectively, the "Service") provided by Curious Ventures LLC - Series 1 (d/b/a ParlaPop) ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. User Accounts

To use certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

To exploit, harm, or attempt to exploit or harm minors in any way.
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.
To impersonate or attempt to impersonate ParlaPop, a ParlaPop employee, another user, or any other person or entity.
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm ParlaPop or users of the Service or expose them to liability.
To reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Service, except to the extent that such activities are expressly permitted by applicable law despite this limitation.

4. Subscription Plans and Payments

ParlaPop offers various subscription plans. By subscribing to a plan, you agree to pay the applicable fees as described on our pricing page. Payments are processed through our third-party payment processor, Paddle.

Billing: Subscriptions are billed on a recurring basis (e.g., monthly or annually) as specified at the time of purchase. You authorize us to charge your chosen payment method for these recurring fees.

Cancellations: You may cancel your subscription at any time. Please refer to our Refund Policy below for more information.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Curious Ventures LLC - Series 1 and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

6. AI-Generated Content

The flashcards, phrases, and translations provided by the Service are generated using artificial intelligence (AI). While we strive for accuracy, AI-generated content may contain errors or inaccuracies. ParlaPop does not guarantee the accuracy, completeness, or usefulness of any AI-generated content. You are solely responsible for any actions you take based on the AI-generated content and should not rely on it for critical decisions without independent verification. You acknowledge that the underlying AI models are constantly evolving, which may lead to changes in the nature, style, or accuracy of the generated content over time. Content generated by the Service is provided for your personal, non-commercial use within the ParlaPop application only. Reproducing, distributing, or using this AI-generated content for other commercial purposes is prohibited without our prior written consent. You acknowledge that you use such content at your own risk.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

8. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Curious Ventures LLC - Series 1 (d/b/a ParlaPop) makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Limitation of Liability

In no event shall Curious Ventures LLC - Series 1, nor its members, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Personal Data: Personally identifiable information, such as your name, email address, and payment information (processed by our Merchant of Record and payment processor, Paddle), that you voluntarily give to us when you register with the Service or when you choose to participate in various activities related to the Service, such as online chat and message boards.
Usage Data: Information our servers automatically collect when you access the Service, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Service. This also includes data related to your interaction with the Service, such as language preferences, topics selected, words hidden, and AI generation requests.
Firebase Data: We use Firebase for authentication, database (Firestore), and functions. Firebase may collect data as described in their privacy policy.
Google AI Data: When you request AI-generated content (flashcards, phrases), your prompts (which may include selected topics or custom topics) are sent to Google's Generative AI services. We do not send your personal identification information with these requests beyond what is necessary for the service to function (e.g., user ID for quota management if applicable). Text-to-Speech (TTS) Data: When you use the TTS feature, the text to be synthesized is sent to the respective TTS provider (e.g., Google Cloud TTS, system voices).

3. How We Use Your Information

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Service to:

Refund Policy

1. Subscription Cancellations & Refunds

At ParlaPop, we aim for your satisfaction with our language learning service. Our Merchant of Record and payment services are provided by Paddle.

No Refunds: We do not offer refunds for subscription fees already paid, whether for monthly or annual plans. This includes partial refunds for unused portions of a subscription period.

Cancellation Policy: You may cancel your subscription at any time. Upon cancellation:

Your subscription will remain active and you will continue to have full access to the features of your subscribed plan until the end of your current paid billing period (e.g., end of the month for a monthly plan, or end of the year for an annual plan).
Your subscription will not automatically renew at the end of your current billing period.
You will not be charged any further subscription fees after the current billing period ends.

2. How to Cancel Your Subscription

To cancel your subscription, please follow the instructions provided within your ParlaPop account settings or through the Paddle customer portal if applicable. If you encounter any issues, please contact our support team at support@parlapop.com for assistance.

3. Exceptional Circumstances

While our standard policy is no refunds, we may consider refunds in very limited, exceptional circumstances, such as a demonstrable technical error on our part that prevented you from using the service for a significant portion of your paid period, and only at our sole discretion. Any such requests must be made within 7 days of the issue occurring.
